Terms of Service

By accessing and using Thoko.AI ("Platform," "Service," "we," "us," "our," or "Company"), you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service. We reserve the right to modify these terms at any time. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. It is your responsibility to check these terms periodically for updates.

Thoko.AI provides five core tools: • AI Content Detector: Analyzes text to detect AI-generated content • Plagiarism Checker: Scans for duplicate content across billions of web pages and academic sources • Fact Checker: Verifies claims against credible sources • Text Similarity Checker: Compares documents for matching content • AI Humanizer: Transforms AI-generated text to appear more natural (Coming Soon) These tools are provided on an "as-is" basis to help users verify content authenticity and originality. We do not guarantee 100% accuracy in any detection or verification process.

To use certain features of Thoko.AI, you must create an account. When creating an account, you agree to: • Provide accurate, current, and complete information • Maintain the confidentiality of your password • Accept responsibility for all activities that occur under your account • Notify us immediately of any unauthorized use of your account • Comply with all applicable laws and these Terms We reserve the right to refuse service or terminate accounts that violate these terms.

All content, features, and functionality of Thoko.AI (including but not limited to software, text, graphics, logos, and images) are owned by Thoko.AI, its licensors, or other providers of such material and are protected by Zimbabwean and international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive license to access and use the Platform for your personal, non-commercial purposes. You may not reproduce, modify, distribute, display, or transmit any content without our prior written permission. Your submitted documents are your intellectual property. We do not claim ownership of documents you upload, but we may analyze them to provide our services and improve our algorithms.

Payment Terms: • Free Plan: Limited free scans available monthly • Paid Plans: Subscription pricing as displayed on our pricing page • Billing Cycle: Subscriptions renew monthly unless cancelled • Currency: Prices displayed in USD or local currency as applicable • Local Payment Methods: We accept EcoCash, InnBucks, ZimSwitch, Visa, and Mastercard Payment Processing: • Payments are processed securely through PesePay • Billing occurs at the start of each billing cycle • Failed payments may result in service suspension • No refunds will be issued for partial months Price Changes: We may change our pricing with 30 days' notice. Changes will not affect current subscribers until renewal.

Subscriptions: • Your subscription continues until cancelled • Cancellation takes effect at the end of your current billing period • You retain access until the end of your paid period Cancellation Process: • Log into your account and navigate to subscription settings • Click "Cancel Subscription" and follow the prompts • You will receive a confirmation email Refunds: • We do not offer refunds for used services during the billing period • If you believe you were charged in error, contact us within 30 days • Refund requests are reviewed on a case-by-case basis Free Trial: • If applicable, free trial periods must be cancelled before billing begins • Failure to cancel will result in automatic subscription charges

You agree not to: • Use the Platform for illegal or harmful purposes • Submit copyrighted material without authorization (unless for plagiarism checking) • Attempt to hack, reverse-engineer, or compromise the security of our systems • Use automated tools to scrape data or overwhelm our servers • Upload malicious software, viruses, or malware • Violate any applicable laws or regulations • Harass, threaten, or defame other users • Impersonate others or misrepresent your identity • Engage in any fraudulent or deceptive activities Prohibited Content: Do not submit content that is: • Illegal or promotes illegal activities • Sexually explicit or contains child exploitation material • Violently graphic or promotes violence • Hateful or discriminatory based on protected characteristics • Defamatory or violates others' rights

Limitations on Accuracy: • AI detection is not 100% accurate. False positives and false negatives may occur • Plagiarism detection may not find all duplicate content • Fact-checking results are based on available sources and may contain errors • Users should not rely solely on our tools for critical decisions No Professional Advice: • Our service does not constitute legal, academic, or professional advice • Users are responsible for their own verification and fact-checking • We recommend human review of all critical documents Content Accuracy: We strive to maintain accurate databases and detection algorithms, but we make no warranties regarding: • The accuracy of results • The completeness of source databases • The absence of viruses or malicious code • The suitability for any particular purpose

To the fullest extent permitted by law, Thoko.AI and its officers, directors, employees, and agents shall not be liable for: • Any indirect, incidental, special, consequential, or punitive damages • Loss of profits, revenue, data, or business opportunities • Damages resulting from unauthorized access or alterations of your data • Any other damages arising out of or in connection with the Platform Maximum Liability: Thoko.AI's total liability to you for all claims shall not exceed the amount you paid us in the past 12 months, or ZWL 1,000, whichever is greater. Exception: These limitations do not apply to liability that cannot be limited under applicable law, such as personal injury, fraud, or gross negligence.

Termination by You: You may terminate your account at any time by submitting a request through your account settings or contacting us directly. Termination by Us: We may terminate or suspend your account without notice if: • You violate these Terms • You engage in illegal or harmful activities • Your account is inactive for 12 months • You fail to pay subscription fees Effect of Termination: • Your right to use the Platform immediately terminates • Your account data will be deleted within 30 days (except where we must retain it for legal reasons) • Sections that should survive termination will remain in effect

You agree to indemnify, defend, and hold harmless Thoko.AI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from: • Your violation of these Terms • Your use of the Platform in violation of applicable laws • Your submission of content that violates third-party rights • Any disputes with other users • Your use of content obtained from the Platform This obligation applies even if the claim is based partly on our negligence or strict liability.

Governing Law: These Terms are governed by and construed in accordance with the laws of Zimbabwe, without regard to its conflict of laws principles. Dispute Resolution: • Informal Resolution: Before initiating formal proceedings, you agree to contact us and attempt to resolve disputes informally • Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts of Zimbabwe • Arbitration: For disputes not resolved informally, either party may pursue binding arbitration under Zimbabwe Arbitration Act Location: Any legal action or proceeding will be conducted in Harare, Zimbabwe.
